It is done; the list of the 222 permitted health claims is now regulated by the Regulation (EU) No 432/2012 which has just been published at the Official Journal of the European Union the 25th of May, 2012. Therefore, from this date, only health claims in the positive list presented in annex of the Regulation are authorized and usable without time limits as far as conditions of use associated are respected. May 25th, 2012 also announces the start of the countdown for stakeholders who use health claims with negative opinions from EFSA included in the community register. Indeed, the 6 months transition period, after a 2-weeks period of compliance, will begin soon and will be finished the 14th of December 2012, date from which authorities could make controls. In addition, health claims which are used without having been evaluated by EFSA, are now forbidden, without transition period, and may lead to prosecution. However, the pending health claims, usable until a further decision from EFSA, permit to continue communication about a large number of ingredients and applications.
